Volume I of the Multistate Bar Exam Preparation Guide is composed of 1,500 multiple choice questions – 500 in Torts, 500 in Contracts, and 500 in Criminal Law. The questions mimic the actual bar exam, with one important exception. The bar exam currently does not use a fact pattern for more than one question, but our MBE preparation guide does. Why? We believe it is important to be able to dissect a fact pattern in multiple ways, in order to see what any sort of question could be written covering the material in the question. There a few of these questions in each section, but most are one fact pattern to each question.


Each section of the book (Torts for example) is divided into ten multiple choice exams of 50 questions each. They vary from reinforcement of the essentials (i.e., easy practice questions) to those that will challenge any legal scholar. Each sample question comes with an answer key with a detailed explanation of why the actual answer is correct, and how the logic played out to reach the conclusion.


The first question any bar exam candidate should be asking is why do I need this book in addition to taking BarBri, or any other bar preparation course? Many of BarBri's questions are repeated for multiple years, so some of the information does not necessarily reflect the approach used for the current exam. We update our questions once a year to reflect any updates, nuances or direction the Bar Examiners are using in their testing approach.

I am also an advocate for bar students who have successfully challenged mistakes made by bar examiners creating essay questions. In one instance, on the California FYLSE (First Year Law Student Exam) I discovered a mistake that invalidated one of the essay questions and allowed a surprising number of students to pass. After I brought the mistake to the Bar Examiners attention, I was informed that the answers posted were simply "model" answers, and did not necessarily represent the best answer. However, the bar results are initially put into three piles – pass, fail, and regrade. The regrade is for exams that are extremely close to passing, and the reviewers look to see if there is any chance the answers given should allow for a passing grade. In most instances, the answer is no. However, in this particular exam, EVERY ONE in the regrade pile passed the exam – a very silent acknowledgement that the California Bar Examiners had an error on one of the four essays on the exam.
